User's Consent

This Privacy Policy governs the collection and processing of personal information by Touch, an audio and video calling service operated by an individual proprietor based in Coimbatore, Tamil Nadu, India ("we," "us," "our"). It applies to both the Touch app (Users) and Touch Host app (Hosts), and to every visitor and registered user of either, whether or not they complete registration.

We collect, use, store, share, or otherwise process your personal information only based on your explicit consent, given electronically, for the purposes set out in this Policy. By accessing and using the App, you indicate that you understand and expressly consent to this Policy — if you do not agree, please do not use the App. Your continued use confirms your unconditional consent to how we collect, maintain, use, process, and disclose your information as described here. This Policy should be read together with our Terms of Use.

Information We Collect

Information is personal in nature when it identifies a specific user, alone or combined with other information. We collect personal information through the App during the following actions:

  • When you create your account — your name, phone number, gender, city, photo, and any other detail requested during registration. Without registering, the App and its services aren't accessible.
  • When you use the App — information you choose to share is transmitted to the other users you select (e.g. your profile, shown to a User browsing Hosts).
  • When you grant microphone or camera permission — this allows the App to capture your voice and video as part of placing or receiving a call. This is transmitted live, directly to the other person on the call, and is not recorded or stored by Touch — we separately keep a record of who called whom, when, and for how long, for billing and abuse investigation, but never the audio or video itself.
  • When you use the App generally — geographical location, device type, browser (on web), log files, session data, internet/telecom service provider, IP address, and information stored via cookies or local storage.
  • When you recharge your Wallet Cash balance, or (as a Host) request a payout — the amount deposited or withdrawn, your UPI ID (Hosts only), and related transaction information. Our payment partner, Razorpay, collects your card/UPI/bank details directly — we never receive or store them.
  • When you contact support or leave feedback — the content of your message and any information you choose to include in it.

You represent that the information you provide us is authentic, correct, current, and updated. We are not responsible for the authenticity of information you provide, and you are personally liable for, and agree to indemnify us against, any loss arising from a breach of this Policy caused by your own acts or omissions.

How We Use Your Information

Information we collect may be used to:

  • Provide, secure, and validate your registration, manage your account access, and provide a personalized experience.
  • Enable you to use the App and its features, including placing and receiving calls.
  • Administer our business — process payments, maintain transaction records, send transactional communications (OTPs, purchase confirmations, account changes), respond to your inquiries, manage grievances and disputes, and assist with requests like password resets.
  • Review your compliance with our Terms of Use and this Policy, and enforce them.
  • Manage the App, troubleshoot issues, enhance security, detect fraud, and moderate content.
  • Research, analyze, and improve the App and Services — understanding usage, engagement, and demographics, and improving performance and content.
  • Evaluate and improve our own marketing efforts.
  • Cooperate with law enforcement and comply with applicable statutory, legal, tax, and evidentiary requirements.
4

Cookies & Local Storage

The web version of the App may store temporary or permanent data on your device (cookies or local storage) to recognize you on return visits, keep you signed in, and remember your preferences. This data is read only by our own servers. You may block or clear it through your browser, though some features may not work correctly if you do.

5

Third-Party Tools

We use third-party analytics tools to measure app traffic and usage trends. These tools collect non-personal, non-sensitive information — such as which screens are visited and how the App performs — as anonymized logs that cannot reasonably be used to identify an individual user.

6

Confidentiality

We aim to keep confidential any information you provide that can reasonably be considered confidential. We do not disclose or share it — orally or in writing, by us or any employee, agent, or contractor — except where:

  • We believe there is a significant, real, or imminent threat to your safety or life, or to another person's.
  • Sharing is required by law, including in connection with an investigation, court summons, or judicial proceeding.
  • It's necessary to protect or defend Touch's own rights or property.
7

Security Measures

We implement reasonable security standards and appropriate technical measures to secure your personal information in accordance with applicable law — encrypted connections (HTTPS/TLS), hashed authentication tokens, and access controls on our database. While we take all reasonable steps to keep your information secure, no system connected to the internet is completely secure, and we cannot give an absolute assurance against unauthorized access.

8

Children's Privacy

The App requires that anyone using it is 18 or older. It is not designed or intended for use by children, and we do not knowingly collect personal information from anyone under 18. If you are under 18, please do not use the App in any way. If a parent becomes aware that a child under 18 has shared information with us, please contact us immediately — we will take appropriate steps and delete the data from our systems.

9

Disclosure & Transfer of Information

We share information with trusted service providers who support the App, subject to the same standard of data protection we follow ourselves — this includes Razorpay (payments), Firebase (authentication, push notifications, crash reporting), and our database hosting provider. These providers don't have an independent right to use your information and don't further transfer or publish what we share with them.

We may also disclose your information: to comply with a legal obligation, court order, or summons; in response to a request from a law enforcement, governmental, judicial, or statutory authority; to investigate or prevent fraud, illegal activity, or a threat to someone's safety; to establish or defend our own legal rights; or in connection with a merger, asset sale, or other business reorganization, to our successor.

We do not, however, share your mobile number or other personal information with third parties for their own marketing or promotional purposes, and we never sell your personal information to anyone. You may withdraw your consent to sharing with a particular third party at any time by contacting us, though this may limit our ability to provide you the Services.

10

Data Deletion

You can delete your account and its associated personal information at any time from your Profile inside the app, or by writing to us at the email below. Once a deletion request is processed, we remove or anonymize your profile data within a reasonable period — except where we're required to retain transaction records for tax or legal purposes, since erasure may affect our ability to continue providing you the Services in the meantime. See our Account Deletion page for step-by-step instructions and exactly what's removed.

11

Your Rights In Relation To Your Information

You may exercise the following rights by contacting us using the details in Section 15:

  • Right of access and modification — review the personal information you've provided us at any time, and correct anything inaccurate, directly in the app.
  • Right to withdraw consent — withdraw your consent to our processing of your personal information by writing to us, except to the extent processing is needed to verify and act on that very request. Withdrawing consent will affect our ability to continue providing you the Services.
12

Disclaimer for Third-Party Services

Some features may direct you to a third-party platform (for example, our payment processor's checkout page). Any information you provide there is governed by that platform's own privacy policy, not this one. We disclaim liability for the misuse of information you share with a third party through such a link, and are not liable merely because a link to that third-party service appeared within the App.

13

Communications & Notifications

By using the App, you consent to receive important account, transactional, and service-related communications from us via SMS, WhatsApp, phone call, or in-app notification. These may include OTPs, login alerts, payment confirmations, call notifications, support responses, and — only if you've opted in — promotional messages.

You may opt out of non-essential promotional messages at any time by contacting support or using in-app settings where available. Essential communications — OTPs, account security alerts, and payment/withdrawal status — cannot be opted out of, since they're necessary to operate your account.

14

Changes to This Privacy Policy

We may update this Policy from time to time as the App evolves. The revised Policy will be posted in the App, with the effective date at the top updated accordingly — we encourage you to review it periodically.
